Dani California sound familiar?

If you have heard the new single from Red Hot Chili Peppers, it might sound familiar. The single called Dani California has a similar sound to Tom Petty & the Heartbreaker's song called "Mary Jane's Last Dance". If you happen to own legal copies of both of these songs I would really recommend comparing them and seeing what you think. I was listening to the radio this morning and was able to hear a comparison. They sound very close to the same chords with Dani California being played slightly faster. Plagiarism? I don't know.
